A lawyer for a man who killed his teenage son in a fight at a family barbecue sayshis client should not be sent to jail.
Thirty-seven-year-old TEREPAI MAKIKE has pleaded guilty to the manslaughter of his18-year-old son BENIAMINA MAKIKE.
The Victorian Supreme court has heard that the younger man died from a brain haemorrhageafter an artery burst in his neck following blows to the head.
His father admitted elbowing his eldest son to the head two or three times when theyfought at the family's Noble Park home in June last year.
The accused man later told police he became angry after over hearing his son tryingto persuade a younger boy relative to smoke marijuana.
Both the accused and the victim had been drinking heavily.
Barrister PAUL DARCY told Justice DAVID HARPER that jailing MAKIKE would create abjectmisery for his wife, younger son and daughter.
But Crown Prosecutor ROSEMARY CARLIN has called for an immediate jail sentence.
Justice HARPER will sentence MAKIKE on August the 26th.
